How to request an extension of stay in the United States?

Learn how to apply for non-immigrant visas and extend your stay in the United States.

There are several categories of non-immigrant visas under the Immigration and Nationality Law, such as vacation or business visas; student and exchange visitor visas; and visas for temporary workers.

Following the suspension of routine visa services at U.S. embassies and consulates due to the COVID-19 pandemic, services have been resumed in February this year.

How to request an extension in your stay in the USA?

If you have any of the aforementioned visas, you can request an extension of your stay in the United States. However, you must meet the following requirements:

  • The United States authorities legally admitted you with nonimmigrant status.
  • Your nonimmigrant status is current.
  • You have not committed any crime that takes away your right to receive immigration benefits.
  • There are no reasons that force you to leave the country.
  • Your passport is valid for the time you have requested to stay in the United States.

If you meet the requirements, you must complete form I-539, which you can obtain here: https://www.uscis.gov/es/formularios/i-539

After filling out the form, you must submit it either by mail, or electronically online. After submitting it, check the status of the application by entering your assigned case number in the following link: If you meet the requirements, you must complete the I-539 form, which you can obtain here: https://egov.uscis.gov/casestatus/landing.do
