U nonimmigrant status, or U Visa, is a humanitarian visa program created to protect victims of crime or physical and mental abuse.
It is worth mentioning that having DACA or U Visa is not about legal status, but rather a temporary measure. However, unlike DACA, which does not have a path to permanent residence, U-Visa holders can obtain permanent resident status.
Current DACA recipients can petition for a U visa as long as they qualify and meet the established criteria (See the full eligibility criteria here).
Previously, when the Citizenship and Immigration Service (USCIS) accepted new DACA applications, it was possible to make both requests simultaneously. Currently, the confusion that can be generated is about the work permit, for example, a DACA beneficiary can obtain their work permit more quickly while the process to obtain a work permit for U visa holders can take up to five years.
Because USCIS has multiple offices, the processing of each type of petition is carried out in different locations and sometimes they do not communicate with each other. Therefore, in this type of case, it is best to ask for the advice of an immigration lawyer so that they can consult the best options.
