State laws allow workers regardless of immigration status to receive compensation benefits in the event of an accident at work.
In the United States, various laws at the state level provide protection for all workers who are injured on the job. In this way they can access workers' compensation benefits or workers’ compensation benefits.
In the state of California, for example, all workers, regardless of whether they are undocumented, are eligible to obtain compensation benefits in the event of an accident at work. These benefits cover the cost of medical treatment and in some cases the replacement of wages.
In this state the Workers’ Compensation Appeals Board, is the body in charge of receiving complaints regarding compensation and ensuring that workers obtain their treatment, rehabilitation and other benefits.
In addition, the state of Texas has a Workers' Compensation Law, which provides compensation in income and medical benefits to employees who have suffered work-related injuries or illnesses.
Employees that are part of the workers' compensation system include undocumented workers.
And the body in charge and regulating this law is the Department of Insurance in the Division of Workers' Compensation (TDI-DWC). Learn more in the following links: http://www.tdi.texas.gov/wc/employee/index.html and http://www.tdi.texas.gov/consumer/complfrm.html
