On May 11, the public health measure title 42 or Title 42 came to an end after more than three years.
On April 27, the United States government through the Department of Homeland Security (DHS) announced new measures to manage regional migration on the southwest border. These measures seek to significantly expand the legal pathways for migration and protection for immigrants, favoring safe, orderly, and humane processing of migrants.
On May 11, the Title 42 public health order came to an end, however, this does not mean that the border will be unprotected, but that it will once again use Title 8 immigration authorities to process and remove people who cross. the border illegally. In addition, the measures announced by DHS will be implemented in coordination with the governments of Mexico, Canada, Spain, Colombia, and Guatemala.
Title 8 processing measures for people found to be crossing the border illegally include: processing under expedited removal authorities in a matter of days; will be barred from re-entering the country for at least five years if ordered removed/deported; and will not be eligible for asylum under the proposed bypass rule.
In this sense, the DHS invites migrants to avoid these consequences and to use some of the legal channels offered by the US government for orderly migration. For example, they have expanded access to the CBPOne mobile app, which allows you to schedule an appointment with immigration authorities; new family reunification processes for countries like El Salvador, Guatemala, Honduras and Colombia; or the increase in the number of refugees from the Western Hemisphere.
Another measure is the humane management of migratory flows with regional partners, for example: opening regional processing centers throughout the Western Hemisphere to facilitate access to legal pathways; launching an aggressive anti-smuggling campaign targeting criminal networks in the Darién (Panama-Colombia border); increase deportations of those who do not have a legal basis to stay; and combat smuggler misinformation
The last measure is to facilitate the safe, orderly and humane processing of migrants. This measure seeks to change the structure that drives people to leave their countries and opt for illegal immigration.
However, it is worth mentioning that the application of these measures does not eliminate the need for Congress to act to provide the necessary reforms and resources to comprehensively address the challenge posed by migration in the region.
