Undocumented immigrants must meet their tax collection responsibilities in the United States. Income taxes also apply to them and if they evade paying taxes it can result in greater chances of deportation and less opportunity to fix their immigration status. The tax return must be done every year to avoid these problems.
To make the payment of taxes, it is necessary to process the Identification Number for Individual Taxpayers (ITIN, for its acronym in English). As explained by the Internal Revenue Service (IRS), the ITIN “is a tax processing number issued by the Internal Revenue Service. The IRS issues ITINs to individuals who are required to have a United States taxpayer identification number, but who do not have or are not eligible for a Social Security number (SSN) ” .
By obtaining this number, you will not be regularizing your immigration status, it is only valid for paying taxes. However, the IRS cannot use the information you provided to deport you, as required by section 6103 of the Tax Code.
With an ITIN, it is possible for immigrants without documents to file a tax return without problem, they can even obtain a refund if they have paid more than required.
