Immigrant families can access the Health Insurance Marketplace if they are legally present in the United States. On the other hand, undocumented immigrants are not eligible to purchase health coverage, but they can apply for coverage on behalf of documented persons.
With the term “legally present” migrants, the US government considers: those with “qualified non-citizen” immigration status; persons in a situation of temporary protection, asylum seekers or victims of trafficking; people with valid non-immigrant visas; and immigrants with legal status, such as temporary resident and others.
Undocumented immigrants are not eligible for federal or state programs such as Medicaid, nor are they eligible to purchase insurance through the Marketplace. However, Medicaid payments to emergency services can be made by a person who is legally present in the country and others obtain the benefits. So legally present migrants who are not yet eligible for Medicaid, or undocumented migrants, can receive that emergency care.
