Obtain Green Card through family members

The permanent residence or Green Card, is the document that allows immigrants to live and work permanently in the United States. It is usually obtained through an employer or family member.

Initially, the Green Card can be granted for two years and be extended up to 10 years, however, after that period has elapsed, it is possible that the applicant renews the agreement if it still meets the requirements.

One of the eight categories to obtain the Green Card is through a relative, most of the applicants who obtain it do so through this means. As of March 9, 2021, applicants are not required to submit Form I-944, nor documentation required by it, as it has been discontinued.

The immigration laws of the United States allow foreign persons who are relatives of United States citizens and permanent residents to become legal permanent citizens, that is, obtain a Green Card.

The first option is permanent residence for immediate relatives of a US citizen. That is, if the applicant is: spouse, minor son or daughter, mother or father of a United States citizen. US citizens seeking their family members to immigrate to the United States must file Form I-130, Petition for Alien Relative: https://www.uscis.gov/es/i-130.

Under US law, it is possible to obtain the Green Card while in the United States or outside the United States. Other ways to obtain a Green Card through a relative are the following:

  • First Preference (F1) - sons and daughters of US citizens, who are unmarried and 21 years of age or older
  • Second Preference (F2A) - spouses and children (unmarried, under 21 years of age) of lawful permanent residents
  • Second Preference (F2B) - 21-year-old unmarried sons and daughters of lawful permanent residents
  • Third (F3) - married sons and daughters of US citizens
  • Fourth preference (F4) - brothers and sisters of US citizens if the US citizen is 21 years of age or older
